Cyber crime

Development of information technology is one of the most dynamic parts of today's global society. Along with the coming of new technologies it generates new types of crime, eventually existing types of criminal activities in this area are moving from the real world to cyberspace. This rapid development of cyber crime enforces corresponding changes in the legislation related to cyberspace. In the Czech Republic the most fundamental changes in cyber crime law have been made along with the new Criminal Code. The new code has modified some areas, that were not mentioned by previous criminal code, refined or amended previous terminology related to cyberspace and added institutes required by international commitments, especially by the Convention on Cybercrime. The purpose of this diploma thesis on "Cyber crime" is to outline the issues of cyber-crime, point out some troubling topics, which are currently present in cyberspace, and outline possible future development of criminal law in cyberspace. In the beginning of the thesis there is a short summary of cyberspace and cyber crime history, that is followed by definitions of selected basic concepts of cyberspace and cyber crime. Internet and computer criminality Summary This thesis, as its name indicates, deals with the problems of our times associated with computers and the Internet, which make it possible to commit all sorts of crimes. Computers are part of our daily life and the sphere of information and communication technologies are constantly and rapidly developing, which gives space to potential perpetrators to find new approaches. The thesis is composed of eight chapters. The opening chapter of this thesis describes the basic concepts related to computer and Internet criminality. It includes the definitions of computer criminality, cybercrime, cyberspace, as well as basic technical concepts such as computer, hardware or software. Approximation of this terminology is essential to understanding the issue. Next chapter is devoted to some illegal activities in cyberspace, which are then legally assessed. The third chapter forms the most important part of the whole thesis because it describes in details the issue of copyright violations in connection with computers. At first it generally talks about intangible goods, and after that it acquaints to readers with piracy of audio and audiovisual works and later with software piracy. The opportunity makes the thief: exploration of the practical using of the crime opportunity theory

The opportunity theory for crime is composed of three partial concepts. The first concept is the routine activity theory that works with a potential offender, a suitable target and a capable guardian. The opportunity for crime occurs in the moment when the offender faces the target while guardians are absent. The second concept, the rational choice perspective, is based on the idea that the offender considers benefit and risk stemming from the crime. The third concept is the crime pattern theory that focuses on the importance of time and space. This master thesis focuses on the usability of the opportunity theory for crime in the context of our current society. Although the opportunity theory for crime is nearly forty years old, this work shows that it is also applicable on cybercrime since some of the "classical" crimes moved from physical space to cyberspace. The potential offender and suitable target exist and behave similarly in cyberspace and in physical space. The difference between the two worlds is notable for the capable guardian, who does not occur randomly in the cyberspace but is embodied in the form of ever-present protection. Market analysis of security software

In this thesis, I analyze the global supply of security software (for operating system Win-dows) with a focus on anti-virus programs, which currently mostly implicitly include vari-ous modules of security software. In the first part of my thesis, I will focus on the clarification of issues related to IS / IT se-curity and cybercrime. I describe here the security IS / IT in general, describes the basic concepts and information safety, so that readers gain a basic understanding of this issue. I explain the concept of cybercrime and characterize its main crime. The second part will focus on the clarification of issues relating to security and safety not only domestic, but also corporate computers. I further characterize the greatest threats of our time for PC users and the possibility of prevention. In the third part, I will analyze the security software market analysis due to their market shares and qualifying tests conducted by recognized independent organizations, so to currently provide their full offer. Using the survey I will find out what is the awareness on the selection and use of antivirus software, and on this basis determine what antivirus software are most popular by users.
